Questions for the Prime Minister

  1. Is the Prime Minister aware of allegations that the correct "case law" resulting from the Bushell/Byrnes/Deledio precedents has not been applied to large numbers of veterans' applications for disability pensions?

  2. Is the Prime Minister aware that replies to Terry Fogarty from the Repatriation Commissioner (12/12/06), the Prime Minister's Parliamentary Secretary (Hon Tony Smith) (10/4/07) and Mr Alex Anderson, Assistant Secretary Legal Policy Branch of the Department of the Prime Minister and Cabinet (27/4/07) are all incorrect?

  3. Is the Prime Minister aware that large numbers of these errors have not been corrected by either the Veterans' Review Board or the Administrative Appeals Tribunal?

  4. Is the Prime minister aware that the Doctrine of the Separation of Powers has been circumvented and that there is no ability for veterans to prosecute criminal offences under VEA Sect 4a?

  5. Will the Prime Minister refer the matter to the Chief Justice of the High Court so that he can decide and direct how these issues are to be determined according to law?

  6. If legislation needs to be changed to facilitate referral to the Chief Justice will the Prime minister initiate these changes immediately?
