It is inordinately difficult to battle and win each case individually. Graham MacLeod has been doing it for 20+ years and despite his undoubted brilliance can only win one case at a time. The probable pool (from DVA Annual reports) is about 110,000 veterans. Ive previously worked on a conservative 10% requiring adjustment. Halving the suggested figures in the info below gives about 40%. Multiply that by the difference between TPI and 100% GR and then back date claims appropriately (5 Years?) That figure (billions of dollars) represents the enormity of the crimes against veterans. I think we still have to win the war first (as in exposing and dealing with cheating by using incorrect rules at all decision and review levels) and then negotiate the peace treaty. Table below is an extract of info I sent to David Barnes. Its obviously a big job to refine those figures properly (Browse 2,000 AAT reports (20 pages each?)) However it should be obvious that cheating on the rules will be the biggest scandal in Australias history. The table below gives an indication of what could be found by searching the AAT web site. The cases below would have to be individually checked (or a reasonable sized sample checked). Obviously if there are x number of cases at the AAT then there are more at the VRB and more again at DVA. Including operational as search term will find cases which are non operational The raw figures below suggest that approximately 80% of cases involving operational service have not used the Bushell/Byrnes/Deledio precedents. In other words the correct rules have not been used in 80% of those cases. The cautionary is that these figures need to be verified by checking the individual cases. I went before the AAT in (I think, it's all a blur at the moment) 2002 or '02. The very rough outline of the case from memory is: DVA had accepted my claim for PTSD but I wanted it recognised as Service Related. The VVA sent me to a lawyer, who I met once (with my partner) and then corresponded occasionally by mail & phone. Three or four day's before the AAT Hearing (THREE DAYS), he rang to say he could not appear for me but would hand the case to a competent colleague (Panic!) I had two psychiatrists appear for my.defence and one who addressed the court by letter. I had one witness appear and one who the whoever they call the judge (Ms Purcell) would not allow. I arrived one hour early on the first day of the hearing as instructed, to get acquainted with my new defence solicitor. She arrived twenty minutes before the hearing started and new NOTHING about my case. Nor did she have ANY of the photographs nor other documents I had given the original solicitor for my case. She just had time to introduce herself and basically said that we would do it on the fly. One the first day I was in the dock answering a barrage of questions in legal-speak that confused the shit out of me. This went on for about two thirds of the day. The other two & one third days I had to listen to the lies and crap their (DVA's) lawyer said and from the (Naval Historian's by phone link to Canberra) and other phone line witnesses, without being able to defend myself. What I think You Want To Hear: The DVA Defence mouthpiece was not local. He was brought in from Canberra, I assume all expenses paid for the three days in Adelaide. He was bombastic, rude and a very dislikeable little man. He had obviously studied the case with his phone link buddies in Canberra and with no right of reply and my defence solicitor (although a very nice person) new NOTHING of the details of my case - I lost. It took my original Lawyer over one year to inform me of the decision and that was only after I rang him to ask. Oh, the bit above about my stand in solicitor not being given any of my defence material - I happened to have a couple of spare photographs with me, in my bag. It took my solicitor some time to convince Ms Purcell that they could be used as evidence. Sorry Allen. This is a story that has been bottle up in my head for several years and which I'm trying to forget. I do feel better now I have written it out....
